Текста будет много. Тут моя история и просьба помочь советом. Комментарии для минусов оставлю и буду благодарен, если немного поднимете, может кто увидет и поделится своим опытом разрешения таких ситуации.

Решил поделиться своим негативным опытом работы на сайте freelancer.com

Надеюсь, хоть кого-то это предостережение оградит от возможных проблем.

Итак, сама история.

Где-то около года назад появился заказчик (звать его Ахмед и он из Лондона). Очень приятный человек, который нанял меня для выполнения различных мелких задачек, типа внести изменения в его софт, фотки на сайте поменять, в фотошопе что-то отредактировать и т. д.

Он открыл проект с почасовой оплатой и мы успешно сотрудничали, оплату я получал только по факту выполненной работы, не ранее как он примет работу и скажет, что изменения не требуются.

И все было хорошо. До мая этого года. Всех своих постоянных клиентов я предупредил, что месяц буду заниматься написанием дипломной работы, и заказы брать не буду.

Все вроде хорошо, и я на месяц ушел в оффлайн.

После сдачи дипломной работы, я вновь вернулся к заказам. И личных сообщениях нашел кучу сообщений от Ахмеда типа "Ты где? мне нужна твоя помощь! Куда ты пропал ? итд.

Ответил Ахмеду, что я его предупредил, что меня не будет и решил поинтересоваться, нужна ли еще моя помощь. Ответа не последовало и я спокойно продолжил работать на другими проектами....

Но не все так хорошо, как оказалось, Ахмед обратился в поддержку сайта с тем, что не может со мной связаться. И накатал на меня жалобу, что я не отвечаю. Т.к. проект не был закрыт, жалобу приняли, несмотря на то, что все работы, за которые я получил деньги - были выполнены.

Я же об этом ничего не знал. Пока не направил деньги на вывод. И тут началось самое интересное - мой счет оказался заблокированным. Об этом я узнал за 2 суток до моей заплнированной поездки на море посредством открытого тикета:

How does this characterizes the employer? He is absolutely not a serious person without any clear goals.

I do not know the text of his complaint ever, but tell me please, how an unsatisfied employer can release 5 milestones for total 100 GBP without accepting my work (I attach a screenshot of received milestones and their dates )?

The last milestone of amount 15 GBP was released on 16 March 2016.

And now, on 15 July I get an information that there is a complaint on me.

Please, look on the dates of the milestone releases. Is not is strange that thee half of it was released a year ago?

Tell me please, do the milestone payment system is not an guarantee not only for employer, but and for employee too?

You know by yourself that the milestone release means the completion of the work, is not it?

As you can see, the description of the last milestone is "Last DB part". This means that I sent all the work to employer and this work and its final version was accepted by the employer.

But the employer "abusmalls" was absolutely not clear in his requirements and asked me to do a lot of work for free. That is why I stopped the communication with him. On the moment we stopped the communication there was not any upcoming milestones or work that was paid and I did not. That is why I want to open a dispute and write a complaint on user "abusmalls", cause my funds are blocked absolutely illegitimately.

The only goal of the user "absusmalls is revenge that I'm not going to work for him for free or very low payments.

I tryed to resolve the problem and contacted the employer via freelancer.com, whatsapp and email. He is not going to respond me. I would like the problem to be resolved and both my vision of this situation to be taken in attention.

Now, the position of the freelancer.com is only 100% on the employer part?

Why is it so? You are holding the funds that were released last time on 17 April 2016 now.

Tell me please, what did I wrong? The milestone were released for hourly rate project. That means that I was paid as per

discussed details with employer on that moment and all of the milestones were paid after completion of project's steps.

For now, I fully think that freelancer.com does not provide any support and defense for freelancers.

Any employer can pay to freelancer and after 3 month on an complaint, the funds of the freelancer can be blocked?

If my funds will not be unblocked in 24 hours, I would like to start dispute process with the freelancer. com. I have right for it according to the terms and conditions paragraph 29:

"If a dispute arises between you and Freelancer, our goal is to address your concerns and, if we are unable to do so to your satisfaction, to provide you with a means of resolving the dispute quickly. We strongly encourage you to first contact us directly to seek a resolution by using our customer support website or emailing us at support@freelancer.com.

For any claim, Freelancer may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. If Freelancer elects arbitration, such arbitration will be initiated through an established alternative dispute resolution (ADR) provider, which is to be selected by you from a panel of ADR providers that Freelancer will provide to you. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

All claims you bring against Freelancer must be resolved in accordance with the terms of this Agreement. All claims filed or brought contrary to this Agreement shall be considered improperly filed and a breach of this Agreement. Should you file a claim contrary to the terms of this Agreement, Freelancer may recover its legal fees and costs (including in-house lawyers and paralegals), provided that Freelancer has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.

If any proceeding by or against you is commenced under any provision of any bankruptcy or insolvency law, Freelancer will be entitled to recover all reasonable costs or expenses (including reasonable legal fees and expenses) incurred in connection with the enforcement of this Agreement.

Freelancer's failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches."

I would like to start arbitration process in 24 hours cause for a day I did not get any exact answer about why my funds are blocked. You are saying about a complaint, but what does the employer want from me? You even did not know the text of complaint, I think.

I would like to know what ADR providers can be used on freelancer.com and how can I start a dispute against freelancer.com

С 16 числа я не получаю ответа ни на одно сообщение от поддержки. Единственный выход  - открытие диспута с сами сайтом, но сама ситуация до боли идиотична. Кому-то через месяцы после выплат вздумалось написать жалобу на меня и ее приняли. Ответа нет никакого, спор с сайтом открывать не хотят, что напрямую нарушает пользовательское соглашение: https://www.freelancer.com/about/terms

Есть ли у вас опыт решения таких проблем? Я был бы рад советам.

А так, на этом моя работа фрилансером окончена, с понедельника начинаю ходить на собеседование в офисы.
